Decision clears way for murder conviction in the death of Paramedic Michelle Smith.
A Delaware Superior Court judge ruled this morning that Paramedic Michelle Smith was acting as a firefighter when she was killed by a driver while tending to an injured man on the side of a highway late last year, according to The News Journal.
The ruling allowed paraplegic Joseph Taye -- who had been using a stick to work the vehicle's pedals -- to be found guilty of first-degree murder for his role in the Dec. 20, 2008 incident on U.S.

Two firefighters in Mississippi had to be rescued after their fire truck flipped yesterday (Nov. 19) while responding to a call, according to WLOX-TV.
The two Forest County volunteer firefighters were on en route to a car fire at approximately 1 p.m. when the incident occurred.
Fire Coordinator Chip Brown told the news station that the fire truck's driver was rushing to the call when he lost control, causing the vehicle to roll over.
Both firefighters were transported to the hospital with unknown injuries.

Six firefighters suffered non-life threatening injuries on Thursday morning while battling a fire on Dinah Court near Ravenwood Country Club in Donelson.
Emergency officials said the floor of the home fell through, trapping three firefighters at about 7:30 a.m. Firefighters on the scene rescued their co-workers and they were transported to Vanderbilt Medical Center.
One other firefighter was later transported. Two additional firefighters were treated and released from Summit Medical Center.

It broke out early in the afternoon north-west of Curramulka and was fanned by strong winds on a day of extreme temperatures.

Police are looking for an arsonist they said set fire to a home two times early Thursday.
The fire was set at a home on Portage Avenue near Adolpha Avenue.
Firefighters said when they arrived around midnight the fire was fully involved with flames shooting out of the roof.
Although the home was vacant, firefighters worked hard to prevent the flames from spreading. However, the home next door suffered minor damage during the blaze.

A man was rescued from his truck in Bothell after it plunged 100 feet down a ravine late Tuesday, reported KIRO 7 Eyewitness News.
The truck careened straight over the road's edge, taking out a chain-link fence on the way down.
The truck ended up beneath the intersection of 205th Street and 123rd Avenue Northeast, where it remains Wednesday morning.

An overnight fire shut down a Spartanburg textile plant and left firefighters struggling to keep the charred structure from collapsing.
Crews were on the scene of the Martex fiber plant on Southport Road all night. Crews were called out to the plant just before 11 p.m. on Monday.
It took more than 60 firefighters to knock down the flames that officials described as "heavy" when they first arrived. Once they tackled the flames, crews worked to put out hot spots around the structure.

The first blaze sparked at about 9 p.m. at the Arbours of Hermitage apartment building off Old Hickory Boulevard.
Police arrested Robert Sibert, 46, and charged him with aggravated arson in the case.

Three Gadsden firefighters were injured when a floor collapsed into the basement of a burning home last night (Nov. 16), according to The Gadsden Times.
Two of the firefighters suffered minor injuries and the condition of the third had been undetermined when ambulances transported them to a local hospital, Assistant Fire Chief Randy Smith told the newspaper.
Smith said none of the injuries to the firefighters were life-threatening.

White New Haven firefighters are seeking promotions after winning their discrimination lawsuit before the U.S. Supreme Court.
Twenty firefighters, who include one Hispanic, sued New Haven after the city threw out results of a 2003 promotion exam for lieutenants and captains when too few minorities did well. The Supreme Court ruled in favor of the firefighters in June.
The firefighters' attorney filed papers in U.S. District Court on Friday asking that 14 firefighters be promoted.

A 60-year-old woman was rushed to a local hospital with severe burns to her face, arms and chest Friday evening after her home caught fire, but before her home exploded, authorities said.
Aurora Fire Battalion Chief Mark Turley said the woman's home on North Xanadu, near East Colfax Avenue and Interstate 225, was engulfed in flames when firefighters arrived.
Turley said firefighters were able to rescue the woman out of her burning home before her oxygen tanks began to explode.

Richard Serino, the newly appointed deputy administrator of the Federal Emergency Management Agency (FEMA), told a group of about 100 providers at a conference in New Hampshire that he fully intends to use newly acquired political clout to get more funding for emergency medical service.

Fire tore through a home in southwest Oklahoma City early Monday, killing all four people inside, authorities said.
Firefighters arrived at the home around 5:20 a.m. and found the one-story brick building engulfed in flames, Battalion Chief Brian Jackson said. They managed to pull one victim from the house, but the rest "were too far gone," he said.

Adding to the transportation chaos this morning, a fire broke out about 7 a.m. on a SEPTA R5 Paoli train with about 300 passengers aboard in West Philadelphia.
The fire was contained and the train evacuated with no reports of injuries, SEPTA officials said.

A two-alarm fire broke out Tuesday night in a two-story home at 18 Clinton St. in Lynn, fire officials said.

A small amount of agricultural lime has spilled from three California Northern Railroad cars that derailed in Davis Tuesday afternoon, although officials say there is no danger to the environment.

Kokomo Fire Chief Pat O'Neill said Monday he was awaiting additional information before commenting on the Saturday accident that injured four and heavily damaged a city fire truck.
But a Kokomo police accident report issued Monday exonerated the three firefighters involved in the crash.
One of those three men, James Newburn, 55, Kokomo, was in stable condition at Howard Regional Health System Monday.

NIOSH investigators have determined that alcohol was again a factor in the death of a firefighter who perished in 2008.
Following a probe, they found that Richard L. Kear, of Pitt Township, Ohio Fire Dept., had a blood alcohol level above the state intoxication limit of .08.
They did not release the blood alcohol level in the report released late last week.

A man and a 2-month-old child died and two others were critically injured when a fire swept through a house near downtown Chillicothe last night.
Chillicothe firefighters found the body of James S. Beverly, 37, in the house at 164 W. 4th St., said Officer Bud Lytle of the Chillicothe Police Department.
Beverly apparently had escaped the burning house, but went back inside to try to help others, authorities said.

A fire burned an Olathe house killing a man and also prompted an oxygen tank to explode.
Fire crews rushed to a house on North Jan-Mar Drive near East Elizabeth Street around 6:30 p.m. Saturday.
Fire officials said the oxygen tank belonged to a 75-year-old and the man was smoking a cigarette when the tank exploded.

A fire at a southeast Portland home Tuesday morning killed three pets and resulted in an injury to a firefighter.
Portland Fire & Rescue Lt. Allen Oswalt said the home on Southeast 76th Avenue was fully engulfed in flames before firefighters arrived at the scene at about 5 a.m.
All of the people inside the home escaped before crews arrived, but two cats and a small dog perished in the fire. Two other dogs were able to escape, Oswalt said.

It took firefighters, two ladders, a catch pole and finally dog treats to rescue a pooch stranded Monday evening under the Carroll Creek Bridge on Bentz Street.
An hour of worry ended happily for Kimberly Henry and her daughter, Lexie Taylor, 8, when their dog, Bailey, came up the fire department ladder in the arms of one of the firefighters.
"It's a happy ending, so I don't mind," Henry said after she got home with daughter and dog.

The fire official told Eyewitness News 5 that investigators are returning to the scene of the deadly blaze to re-interview people with whom they spoke earlier.

Fire crews extinguished a blaze at a welding supply company in Marysville Monday after a series of explosions rocked the nearby neighborhood and injured a worker.
The first explosion at the South Park Welding Supplies LLC plant at 50 Gratiot Blvd. near the Port Huron and Marysville city line broke out around 8:20 a.m. when a worker removed a valve from a settling tank.

A 76-year-old man barely escaped a fire early Monday morning.
Fire crews said he was hard to rescue because of all of the clutter in his home.
Fire investigators said two neighbors called police when they saw heavy smoke coming from a front bedroom of the Cleveland Heights home.
When fire crews arrived at the scene on Noble Road, they found the man collapsed in the hallway with burns on 40 percent of his body.

Firefighter Michael Remper said he didn't hesitate Monday morning when he heard children screaming from the second floor of a burning house in West Tarentum.
"I went through the flames to grab the two kids and the mother and drag them all out," said Remper, assistant fire chief of the Summit Hose Company.

First responders, families of Sept. 11 victims and the public gathered Monday at a waterfront viewing area, where they could see the crew standing at attention along the deck of the battleship gray vessel.
The big ship paused. Then the shots were fired, with a cracking sound, in three bursts.

WASHINGTON, D.C. -- Responders have revived legislation that will permit notification of personnel exposed to HIV or other serious illnesses.
On Friday, President Obama signed the Ryan White legislation that includes the provision allowing hospitals to notify personnel about certain exposures within 48 hours.

A Government Accountability Office review released Oct. 30 found that FEMA is meeting most requirements for awarding FIRE Act funds, but that more can be done to improve the grant process.According to the GAO report, the agency met seven of eight statutory requirements and two of three established program requirements for distributing fiscal years 2007 and 2008 FIRE Act grants.
The report also stated the agency has taken actions to ensure that its fire grants award process is accessible and clear to grant applicants.

MERRICOURT, N.D. -- Merricourt used to have its own fire department. Now fires in and around the town are fought by fire departments in Ellendale, N.D., and Edgeley, N.D.
Merricourt, a town of less than five people about 50 miles south of Jamestown, lost its fire department about three years ago because its fire chief retired and no one took over, said John Elstad, deputy fire marshal for the central region of North Dakota.
"It's never a good thing when a fire department has to close up," Elstad said.

A huge fire at an Indian oil depot that has killed at least six people and injured 150 will be allowed to burn out as firefighters have little hope of dousing it, officials said Friday.

Tornadoes hit Louisiana, Arkansas
SHREVEPORT, La. --
One man is dead and a landmark church steeple toppled onto a car in Louisiana after a line of thunderstorms spawned several tornadoes there and in neighboring Arkansas.
Authorities said an unnamed 20-year-old driver died when his car hit a tree felled by the storms Thursday near Shreveport.
At least three tornadoes touched down in northwest Louisiana.

Acting on a tip, Kissimmee fire officials today determined that two residents trying to exterminate bees sparked a fire that left 30 people homeless and destroyed a building.
Two residents doused a beehive with flammable spray as it hung from a second-floor landing at Villa del Sol condominiums, firefighters said. They then lit a match and touched it to the hive, causing flames to erupt.

Two volunteer firefighters are facing aggravated arson charges after being accused of starting at least one fire at a vacant residence on Mowbray Mountain then coming to the scene to put out the fire.
Mowbray Mountain firefighters George Lewis, 19, and William Harris, 18, were indicted by a Hamilton County grand jury in connection with a June 17 fire at 1601 Poe Road.
Investigators determined the fire likely started as a result of arson, Hamilton County Sheriff's Office spokeswoman Janice Atkinson said.

A nine-hour police standoff ended Thursday night, and police said they've got the suspect in custody.
It started at an apartment in the 700 block of Upperline Street, just blocks from the Mississippi River Uptown, at about 11:30 a.m.
First City Court Constable Lambert Boissiere said a deputy was visiting 60-year-old Richard Scearce to serve him with an eviction notice when Scearce barricaded himself inside, set fire to the building and fired several gunshots.

As thousands of volunteers prepare to walk the streets of Saginaw in a community-wide effort to prevent intentionally-set Devils Night and Halloween fires, two east homes went up in flames Thursday morning.
Fire officials said both suspicious fires are being investigated as arson by the Saginaw County Fire Investigative Services.
The first blaze occurred about 1:45 a.m. at an abandoned one-story house on 9th Street. Fire officials said the structure will likely be demolished.

Dayton firefighters said a 52-year-old man died in a house fire early Thursday morning.
The flames hit a home in the 2600 block of East Third Street near Philadelphia Street around 5:30 a.m.
Fire officials said they were called to the scene on a report of smoke in the building. When they arrived, the wife of the 52-year-old man who died told them that her husband was still inside their half of the two-story duplex.

A woman was revived following the blaze
PHELAN, Calif. --Just after fire officials saved more than 50 animals from a Phelan rescue center, paramedics were called to help save the life of a woman across the street from the burned-out structure, San Bernardino County Fire Department officials said.
As officials were leaving the scene early Tuesday morning, someone came out of a home directly across the street from where the fire took place and said their female family member had stopped breathing.

FORT WORTH, Texas -- A jury sentenced Johnny Waller of Watauga to 45 years in prison Wednesday on three charges related to the arson death of a man in Haltom City in June 2008.
Waller, 27, was convicted of arson of a habitation causing death, felony murder and first-degree burglary of a habitation on Tuesday. On Wednesday, the jury sentenced him to 45 years on each charge in Judge Wayne Salvant's Criminal District Court No. 2, to run concurrently.

Baltimore's 1,600 firefighters and fire officers voted overwhelmingly Wednesday night to take five unpaid furlough days before June in order to help the city close a $60 million budget gap.
The city's agreement with the two unions also calls for a pay freeze in the next fiscal year, but union members will be spared threatened pay cuts. The deal is worth $2.9 million to the city.

A woman died at her apartment late Tuesday after trying to shed a bathrobe that had caught fire, officials said.
A passer-by saw the woman, later identified as Linda Gadd, 58, on her balcony, on fire, said Jason Evans, spokesman for Dallas Fire-Rescue.
The passer-by climbed up and put out the flames with a fire extinguisher, Evans said.
But it was too late.
Firefighters were called at about 9 p.m. to the one-alarm fire at the Pavilion Town Place, 7700 W. Greenway Blvd. in north Dallas.

As expected, a bill that increases SAFER funding and cuts FIRE Act money is headed to President Barack Obama for his signature.
On Thursday, the Senate passed the House Resolution that funds the Department of Homeland Security through Sept. 2010.
The bill earmarks $420M for SAFER compared to $210M funded last year.
However, money for FIRE Act grants went from $565M to $390M.
Funding for Emergency Management Performance grants and Emergency Operations Centers was increased.
